Definitions

• Site: the website at kokukitchen.com, in English, Catalan and Spanish.
• Restaurant (or "we", "us"): DE LISTUIN AND SANS SL, the company that runs the Koku Kitchen restaurants in Barcelona and owns the Site.
• Website Operator: BEAUT1FUL NET S.R.L., the company that builds and runs the Site on the Restaurant's behalf.
• You: the person using the Site.
• Terms: these terms and conditions, which form the entire agreement between you and us about the use of the Site.
• Third-party services: services or content provided by someone else and shown or linked on the Site: TheFork, the delivery apps, social networks and maps.

Who we are

The Site belongs to DE LISTUIN AND SANS SL, with tax ID (NIF) B66245432, at Carrer del Comerç 29, 08003 Barcelona, España. You can reach us at info@kokukitchen.com.

The Site is built and operated on our behalf by BEAUT1FUL NET S.R.L.. The Website Operator is responsible for how the Site works and for the data it collects about visits, as the privacy policy explains. Everything about the restaurants themselves, the menu, prices, bookings, orders and what you eat, is the Restaurant's responsibility. You can reach them through info@kokukitchen.com, which passes your request on to them.

Accepting these terms

By accessing or using the Site you accept these Terms and agree to follow them. If you disagree with any part of them, please do not use the Site. Your use of the Site is also subject to our privacy policy, which describes what data is collected when you use it and what your rights are; please read it too.

The Site is meant for adults. If you are under 18, use it with the permission of a parent or guardian; booking a table or placing an order may require you to be of age under the terms of the service you book or order through.

What the Site is for

The Site tells you about our restaurants, our menu, our opening hours and how to book a table or order delivery. Please use it for that, and not for anything unlawful, or that could harm the Site, the companies behind it or other people: for instance, trying to break into it, overloading it, copying it wholesale or feeding it false information.

Menu, prices and allergens

We keep the menu, prices, opening hours and allergen information up to date, but dishes and prices can change, and what the restaurant offers on the day prevails. Prices on the Site include VAT. The allergen information is a guide: if you have an allergy or an intolerance, tell our team before you order.

Bookings, delivery and third-party services

Tables are booked through TheFork, whose widget is embedded in the Site, and delivery orders are placed on Uber Eats, Glovo and Just Eat. Each of those services has its own terms and privacy policy, which apply to your booking or order; we advise you to read them. The Site also links to social networks and maps we do not run.

We have no control over those third-party services and take no responsibility for their content, policies or how they work, or for any loss caused by using or relying on them. A booking or an order is confirmed by the service you made it through, not by the Site.

Intellectual property

The texts, photos, illustrations, logos, videos and design of the Site belong to DE LISTUIN AND SANS SL, or are used with their owners' permission, and are protected by intellectual property law. You may look at the Site and print or save pages for your own, non-commercial use. Please do not copy, reproduce, distribute or modify them otherwise without our written consent.

Suspending access

We may block or suspend your access to the Site, without notice, if you breach these Terms or use it in a way that harms it or others. Your right to use the Site ends when we do.

No warranty

The Site is provided "as is" and "as available". We do our best to keep it working and its information correct, but we do not promise that it will always be available, free of errors or interruptions, or that its content is complete and current at every moment, and we make no other warranty, express or implied, about it, to the extent the law allows.

Liability

To the extent the law allows, neither the Restaurant nor the Website Operator is liable for indirect or consequential loss arising from your use of the Site or your inability to use it, such as lost profits, lost data or business interruption, nor for damage caused by interruptions, errors, viruses or content from third parties.

Nothing in these Terms excludes or limits a liability that cannot be excluded under Spanish law, including liability for death or personal injury caused by negligence, for fraud, or your rights as a consumer.

Governing law and disputes

These Terms are governed by Spanish law. If you have a concern or a dispute about the Site, please contact us first at info@kokukitchen.com and we will try to resolve it informally. Any dispute that cannot be resolved that way will be settled by the courts of Barcelona, unless the law gives you the right to go to the courts where you live. If you are a consumer in the European Union, you keep the protection of the mandatory provisions of the law of the country where you live.

Severability and waiver

If any provision of these Terms is held to be invalid or unenforceable, it will be read so as to achieve its purpose as far as the law allows, and the rest of the Terms will stay in force. If we do not enforce a right or a provision at some point, that does not mean we give it up: we may still enforce it later.

Translations

These Terms are published in English, Catalan and Spanish. If the versions differ, the English text prevails.

Changes to these terms

We may change these Terms from time to time. The new version is published on this page with its date at the top; if the change is material, we will make reasonable efforts to give at least 30 days' notice, with a notice on the Site, before it takes effect. By continuing to use the Site after that, you accept the revised Terms; if you do not, please stop using the Site.
